How Can Separating Couples Find Support On Divorce Day

Angela Killa, Director in the Family team at JCP Solicitors, explains why the first Monday in January has become known as ‘divorce day’ – and how separating couples can seek support.

Despite divorce rates steadily declining since the 1990s, approximately two in five marriages end in divorce in the UK. With the most common date to begin consulting a divorce lawyer being the first working Monday in January.

Known as ‘Divorce Day’, according to industry reports, 5th January 2026 will likely see divorce lawyers receive double the number of enquiries compared to the daily standard.

Whether citing the stress of the festive period, financial worries, or the fraught emotions which can come from spending prolonged amounts of time together over the Christmas and New Year break, this time of year often sees separating couples pushed to their limits. Couples with children often wait for the festive period to end, so as not to cause upset during Christmas time.

With the New Year signalling a fresh start, it can also feel like the ideal time for new beginnings: many couples who have been considering separation will finally take steps to initiate proceedings.

The introduction of the ‘no-fault divorce’ in 2022 means couples no longer have to attribute blame to either party, reducing the potential for conflict between partners and allowing couples to focus on important issues such as child matters, finances and property. As members of Resolution – a community of family justice professionals promoting constructive and amicable separations – JCP Solicitors supports no-fault divorce and takes a constructive approach to family matters.

Our specialist, knowledgeable and friendly team supports you to find the best solution for your circumstances and stay by your side through what can be a stressful, emotional time.

We can help you to find resolution through mediation, resolving issues in as amicable a way as possible. If children are involved our team takes a child-centric approach, prioritising what is best for the child. We support you with living arrangements, keeping the child’s welfare at heart.

Where mediation is not possible and the relationship has irretrievably broken down, our teams provide specialist guidance to get the best possible outcome for you and your family.

We advise on all aspects of divorce and explain the process clearly and effectively, making sure you understand the timelines and processes involved in financial settlements, child agreements, and divorce proceedings.

Whatever your circumstances, we support you through this stressful time by answering all your legal questions, providing expert legal advice, and offering a listening ear when you need it most.
