How Spinal Injury Claims Work

In order to succeed in a claim for compensation arising from a spinal (or any other) injury it must be shown that the injury was caused through negligence (or breach of a particular statutory obligation) of a third party. Examples might be a road traffic accident caused by excessive speed (negligence) or an accident at work caused by defective work equipment (negligence and breach of statutory duty).

Claims for compensation for spinal injuries are subject to time limits. The time limit is 3 years from the date of the accident or 3 years from “date of knowledge” (if later).

Building your Spinal Injury Claim

We begin by investigating issues of liability and obtaining evidence about the circumstances of the accident. This might be the police report into a motor accident or the report of the Health and Safety Executive into an industrial accident. Witnesses will need to be interviewed.

Supporting medical evidence must be obtained and the claim quantified. If the claim succeeds the usual losses that can be recovered are:

  • Pain suffering and loss of amenity
  • Earnings (past and future)
  • Care & support (family care and paid care)
  • Travelling expenses to and from appointments
  • Additional transport costs
  • Aids & equipment including wheelchairs
  • Therapy (commonly occupational therapy and physiotherapy)
  • Additional accommodation costs
  • DIY and gardening
  • Financial costs

Although most spinal injury claims settle out of court (by negotiation) we begin with the assumption that the case will be determined by a judge after a trial. We prepare accordingly.

Although few cases reach trial it is usually necessary in spinal injury cases to commence court proceedings in order to fully engage the defendant.  This is particularly so if an interim payment is required in order to meet immediate needs. Interim payments (in cases where liability is not in issue) are essential to ensure that any requirements for support, therapy or accommodation are met and that financial pressures do not make a difficult situation much worse.
