Professional Negligence

Our professional negligence team has the benefit of many years experience acting for businesses, lending institutions, insurers and individuals in claims relating to all types of professionals including solicitors, surveyors, architects and IFAs.

The team includes Partner Kevin O'Brien and Partner Keith Thomas. Kevin has many years experience of acting for major lending institutions in claims against solicitors and in valuers’ negligence cases. Kevin also specialises in claims against professionals in construction related matters. Keith exclusively deals with claims arising out of the conduct of personal injury and clinical negligence claims. Keith is instructed by the Official Solicitor in professional Negligence claims relating to the under settlement of catastrophic injury claims on behalf of persons under a disability.

The team is recognised by Legal 500 as one of the leading professional negligence teams in Wales. Kevin and Keith are both members of the Professional Negligence Lawyers Association and Kevin is a member of the Association’s south west region committee.

The decision in Rubenstein v HSBC Bank plc [p2011] EWHC 2304 (QB)

The case starts in August 2005. Mr Rubenstein, a customer of HSBC receives the sum of £1.25m from the sale of his property in North London. Not ready to buy a new house and wanting to put it somewhere safe for future use, he visits his Financial Advisor at his local branch of HSBC for some advice.

Bearing in mind that Mr Rubenstein did not want to take any risks with his capital, the financial advisor recommended the AIG Premier Access Bond, which he viewed as “the same as cash deposited in one of [the bank’s] accounts.”
